By accessing our website, placing an order or purchasing products from Ruff Studios, you agree to be bound by these Terms. Please read them carefully before using our website or completing a purchase.

By accessing our website, you agree to use it only for lawful purposes and in accordance with these Terms.

• Use our website for fraudulent, misleading or unlawful activities.

• Reproduce, duplicate, copy, sell, resell or exploit any part of our website without our written permission.

3. Product Information

At Ruff Studios, we take care to ensure that all product descriptions, images, measurements and details are accurate.

However, actual colours may vary slightly from the images displayed online due to differences in:

• Screen settings.

• Lighting conditions.

• Photography.

• Fabric characteristics.

Many of our garments may feature unique finishes, washes, textures, distressing or variations that are intentional characteristics of the design. These differences are not considered faults and contribute to the individual nature of each garment.

Product availability may change at any time without notice.

We reserve the right to modify, discontinue or update products at any time, subject to any orders that we have already accepted and your rights under Australian Consumer Law.

4. Orders

When you place an order through our website, you are making an offer to purchase products from Ruff Studios.

After placing an order, you will receive an order confirmation email acknowledging that we have received your order.

Your order is accepted once payment has been successfully processed and your order has been dispatched.

We reserve the right to refuse or cancel an order where reasonably necessary, including because of:

• Suspected fraudulent activity.

• Incorrect pricing or product information.

• Payment issues.

• Stock availability errors.

• A violation of these Terms.

If your order is cancelled after payment has been received, you will be issued a full refund using your original payment method.

5. Pricing

All prices displayed on our website are listed in Australian dollars (AUD) and include GST where applicable.

Ruff Studios reserves the right to change its prices at any time without notice. Any price changes will not affect orders that we have already accepted.

While we make every effort to ensure pricing accuracy, errors may occasionally occur. If a product has been listed at an incorrect price due to an error, we may cancel the affected order and provide a full refund using the original payment method.

6. Payment

Payments are processed securely through our approved payment providers.

We accept the payment methods displayed during checkout. Ruff Studios does not store your full payment details.

By submitting payment information, you confirm that:

• You are authorised to use the payment method provided.

• All information you provide is accurate and complete.

7. Pre-Orders

From time to time, Ruff Studios may offer products for pre-order.

Pre-order products may be produced or ordered based on anticipated customer demand and may have estimated delivery dates.

Any estimated delivery timeframe is an indication only and may be subject to delays caused by production, shipping, customs or circumstances outside our reasonable control.

Customers will be notified of significant delays where applicable.

Pre-order purchases cannot be cancelled solely because of a change of mind unless otherwise stated or required by Australian Consumer Law.

Nothing in this section limits any rights or remedies available to you under Australian Consumer Law, including where we are unable to supply a product within the agreed or a reasonable timeframe.

8. Shipping & Delivery

Ruff Studios ships orders using trusted delivery providers.

Delivery timeframes provided on our website or during checkout are estimates only and are not guaranteed, unless expressly stated otherwise.

Delivery may be affected by circumstances such as:

• Courier disruptions.

• Incorrect or incomplete delivery information.

• Customs processing.

• Weather events.

• Public holidays.

• Circumstances outside our reasonable control.

Customers are responsible for ensuring that all delivery information provided during checkout is accurate and complete.

Ruff Studios remains responsible for ensuring that products are supplied in accordance with Australian Consumer Law. If your order is lost or damaged during delivery, please contact us at hello@ruffstudios.com.au so that we can investigate and provide an appropriate resolution.

9. Returns & Exchanges

Ruff Studios wants every customer to be satisfied with their purchase.

Change-of-mind returns and exchanges are accepted in accordance with our Returns & Exchanges Policy.

To qualify for a change-of-mind return, an item must be returned:

• Unworn.

• Unused.

• Unwashed.

• In its original condition.

• With all original tags attached.

We reserve the right to refuse a change-of-mind return that does not meet these requirements.

Certain items may not be eligible for change-of-mind returns due to hygiene reasons, final-sale conditions or product-specific exclusions.

These conditions apply only to change-of-mind returns. Nothing in this section limits your rights under Australian Consumer Law in relation to faulty, damaged, unsafe or incorrectly described products.

10. Australian Consumer Law

Our products come with consumer guarantees that cannot be excluded under Australian Consumer Law.

Products must be of acceptable quality, be fit for any disclosed purpose and match their description, sample or demonstration model where applicable.

If a product has a major failure, you may choose between a refund or replacement. You may also be entitled to compensation for any reasonably foreseeable loss or damage resulting from the failure.

A major failure may include circumstances where the product:

• Would not have been purchased by a reasonable consumer if they had known about the problem.

• Is substantially unfit for its normal purpose and cannot easily be made fit within a reasonable time.

• Is substantially unfit for a purpose you told us about and cannot easily be made fit within a reasonable time.

• Is significantly different from its description, sample or demonstration model.

• Is unsafe.

If a product has a minor failure, we may choose to repair the product, replace it or provide a refund. If we do not provide a remedy within a reasonable time, you may be entitled to have the problem fixed elsewhere and recover the reasonable costs or reject the product and request an appropriate remedy.

Consumer guarantees may not apply where a product has been damaged because of:

• Misuse.

• Incorrect care.

• Normal wear and tear.

• Accidental damage.

• Use that is inconsistent with the product’s intended purpose or supplied care instructions.

Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded under Australian Consumer Law.

11. Gift Cards

Gift cards purchased from Ruff Studios:

• Are redeemable through our online store.

• Will be valid for at least three years from the date of purchase, unless an exception under Australian Consumer Law applies.

• Will display the applicable expiry date.

• Cannot be exchanged or redeemed for cash, except where required by law.

• Must not be resold or used for unauthorised promotional or commercial purposes.

Customers should treat gift cards like cash. Ruff Studios is not responsible for lost, stolen or unauthorised use of gift cards, except where required by law.

We may be able to replace a gift card where valid proof of purchase and sufficient identifying information are provided. Any replacement remains at our reasonable discretion, except where otherwise required by law.

12. Intellectual Property

All content appearing on the Ruff Studios website is owned by or licensed to Ruff Studios, including but not limited to:

• Logos.

• Branding.

• Designs.

• Photography.

• Videos.

• Graphics.

• Product names.

• Written content.

You must not reproduce, copy, distribute, modify or use our intellectual property without our prior written permission.

13. Third-Party Services

Our website may contain links to or integrations with third-party services, including payment providers, shipping providers and analytics platforms.

Ruff Studios is not responsible for the content, security practices or availability of third-party websites or services.

Your use of third-party services may be subject to their own terms and policies.

Nothing in this section limits any responsibility that Ruff Studios has under applicable law.

Ruff Studios is not responsible for losses resulting from unauthorised access caused by your failure to take reasonable steps to protect your account details, except to the extent that the loss was caused or contributed to by Ruff Studios or where liability cannot lawfully be excluded.

To the maximum extent permitted by law, Ruff Studios is not liable for any indirect, incidental, special or consequential loss arising from:
